1. Scope and Applicability
This Acceptable Use Policy (“Policy”) applies to all Blade Outboards products, including without limitation electric outboard motors, controllers, embedded firmware, software, mobile applications, connectivity modules, SIM-enabled devices, cloud platforms, telemetry systems, digital wallet passes, and associated services (collectively, “Blade Products and Services”).
This Policy applies to any person or entity who:
• Purchases, acquires, leases, rents, receives, tests, evaluates, or otherwise obtains a Blade product;
• Uses, operates, activates, connects to, installs, or possesses a Blade product;
• Creates an account or accesses Blade software, applications, or cloud services;
• Registers a warranty or uses a digital wallet pass;
• Accesses Blade connectivity or telemetry systems.
This Policy applies regardless of how the product was obtained, including direct purchase, distributor purchase, resale, transfer, loan, demonstration, promotional giveaway, fleet use, or any other method of acquisition.
Use, activation, registration, or continued operation of any Blade Product or Service constitutes acceptance of this Policy.
2. General Use Requirements
Users must:
• Use Blade Products and Services only for lawful purposes;
• Operate products in accordance with provided manuals, safety instructions, and specifications;
• Comply with all applicable maritime, environmental, telecommunications, export control, and safety laws;
• Ensure proper installation and maintenance by qualified personnel where required.
3. Prohibited Conduct
Users may not:
3.1 Tampering and Modification
• Modify, reverse engineer, disassemble, decrypt, or alter firmware, software, or hardware;
• Bypass safety systems, throttle limitations, battery protections, or thermal controls;
• Install unauthorized firmware or attempt to load third-party code;
• Modify telemetry signals or falsify operational data;
• Connect unauthorized battery systems or power components not approved by Blade.
Unauthorized modification voids warranty and may result in permanent disabling of digital services.
3.2 Connectivity and Network Abuse
Users may not:
• Use Blade-provided SIM cards or connectivity for non-product purposes;
• Reroute, proxy, resell, or redistribute data connectivity;
• Attempt to overload, disrupt, or interfere with MQTT brokers, servers, or APIs;
• Transmit malicious code, automated scripts, or abnormal data traffic;
• Attempt unauthorized access to cloud infrastructure or user accounts.
Blade reserves the right to monitor, rate-limit, suspend, or terminate connectivity where abnormal or abusive activity is detected.
3.3 Account Misuse
Users may not:
• Share login credentials in a manner inconsistent with intended use;
• Create fraudulent accounts;
• Impersonate another individual or entity;
• Access accounts or data without authorization;
• Manipulate telemetry or service records.
Users are responsible for safeguarding account credentials.
3.4 Digital Wallet and Warranty Abuse
Users may not:
• Alter, falsify, duplicate, or manipulate digital Apple Wallet or Google Wallet warranty passes;
• Misrepresent product ownership;
• Use digital passes for fraudulent claims;
• Attempt to override or invalidate official warranty status.
Digital passes are informational credentials and may be updated, revoked, or invalidated at Blade’s discretion.
3.5 Unsafe or Unlawful Use
Users may not operate Blade Products:
• In violation of maritime safety regulations;
• In sanctioned or restricted jurisdictions in violation of export laws;
• In connection with unlawful activities;
• In a manner that endangers life, property, or the environment;
• In military or restricted applications unless explicitly authorized in writing.
4. Data, Telemetry, and System Integrity
Users acknowledge that Blade Products may:
• Transmit operational telemetry;
• Store usage data;
• Communicate via cellular or cloud-based systems.
Users may not interfere with data transmission, manipulate telemetry records, or attempt to disable required system communications where connectivity is integral to product operation.
Blade may use anonymized operational data for product improvement, diagnostics, compliance, and safety purposes as described in its Privacy Policy.
5. Export and Compliance
Blade Products and Services may be subject to export control laws and international sanctions regulations.
Users agree not to:
• Export, re-export, transfer, or use Blade Products in violation of applicable export control laws;
• Transfer products to prohibited jurisdictions or restricted parties;
• Use Blade Products in embargoed regions contrary to applicable law.
6. Suspension and Enforcement
Blade reserves the right, at its sole discretion, to:
• Suspend or terminate connectivity services;
• Disable digital services or firmware updates;
• Revoke digital wallet passes;
• Suspend or terminate user accounts;
• Deny warranty claims arising from prohibited conduct;
• Pursue legal remedies where applicable.
Enforcement may occur without prior notice where safety, legal compliance, or system integrity is at risk.
7. Effect on Warranty and Liability
Any violation of this Policy, including unauthorized modification, tampering, misuse, prohibited deployment, unsafe operation, or circumvention of security measures, may, at Blade’s sole discretion:
• Void all or part of the applicable product warranty;
• Render the product ineligible for repair, service, software updates, or technical support;
• Result in suspension or permanent termination of connectivity, digital services, user accounts, or digital warranty credentials.
To the maximum extent permitted by applicable law, Blade shall not be liable for any damage, injury, death, property loss, environmental harm, regulatory penalties, or consequential or indirect damages arising from or related to:
• Unauthorized modification or alteration of Blade Products;
• Operation contrary to published specifications or safety guidance;
• Violation of this Policy;
• Misuse or negligent operation of any Blade Product.
Users assume all risks associated with operation of any Blade Product that has been altered, misused, or operated in violation of this Policy or applicable law.
8. No Life-Support or Critical Dependence
Blade Products are not designed or certified for life-support, emergency rescue reliance, or mission-critical maritime navigation systems unless expressly agreed in writing.
Users remain solely responsible for maintaining safe navigation practices and independent safety equipment.
9. No Circumvention of Security Measures
Users may not circumvent, disable, defeat, or otherwise interfere with any security feature, authentication mechanism, encryption protocol, firmware signature control, SIM restriction, access control, or system integrity protection implemented within Blade Products or Services.
Prohibited conduct includes, without limitation:
• Attempting to extract encryption keys or authentication credentials;
• Bypassing firmware validation mechanisms;
• Interfering with secure boot processes;
• Jailbreaking, rooting, or modifying embedded control systems;
• Accessing restricted APIs or system endpoints without authorization.
Any attempt to compromise system security may result in immediate suspension of connectivity, digital services, and warranty coverage.
10. Service Availability and Continuity
Blade Products and Services that rely on connectivity, cloud infrastructure, mobile platforms, or telecommunications networks are not guaranteed to be uninterrupted, continuous, error-free, or available in all geographic locations.
Service performance may be affected by:
• Network coverage limitations;
• Telecommunications carrier outages;
• Government restrictions;
• Regulatory actions;
• Technical failures;
• Force majeure events.
Blade shall not be liable for loss, delay, or damage arising from service interruptions beyond its reasonable control.
11. Third-Party Platform and Carrier Disclaimer
Blade Products and Services may depend on third-party platforms and providers, including but not limited to:
• Mobile operating systems;
• Application distribution platforms;
• Digital wallet providers;
• Telecommunications carriers;
• Cloud infrastructure providers.
Blade is not responsible for changes, interruptions, suspensions, policy modifications, compatibility limitations, or service failures caused by such third-party providers.
Continued functionality may depend on compliance with third-party platform requirements beyond Blade’s control.
12. Prohibited Commercial Exploitation and Competitive Use
Users may not use Blade Products, software, telemetry data, connectivity systems, or cloud infrastructure to:
• Develop, test, or build competing propulsion systems or services;
• Extract, aggregate, or resell telemetry or operational data;
• Benchmark products for commercial competitive publication without authorization;
• Provide commercial monitoring or fleet analytics services using Blade infrastructure without written approval.
Unauthorized commercial exploitation may result in immediate termination of access and legal action.
13. Indemnification
Users agree to indemnify, defend, and hold harmless Blade Outboards, its affiliates, directors, officers, employees, agents, distributors, and partners from and against any claims, liabilities, damages, losses, fines, penalties, costs, or expenses (including reasonable legal fees) arising out of or related to:
• Unauthorized modification or alteration of Blade Products;
• Misuse or operation contrary to published specifications;
• Violation of applicable laws or regulations;
• Breach of this Acceptable Use Policy;
• Injury, death, property damage, or environmental harm resulting from prohibited conduct.
This indemnification obligation survives termination of use.
14. Remote Updates and System Actions
Blade reserves the right to remotely deploy firmware updates, security patches, configuration adjustments, compliance modifications, or safety-related system updates to connected products where technically feasible.
Blade may also remotely restrict, suspend, or modify connectivity or digital services where necessary to:
• Protect system integrity;
• Address security vulnerabilities;
• Ensure regulatory compliance;
• Mitigate safety risks;
• Enforce this Policy.
Where practicable, reasonable notice will be provided; however, urgent safety or security updates may be implemented without prior notice.
15. Age and Legal Capacity
Users who create accounts or access Blade digital services must be at least the age of legal majority in their jurisdiction or otherwise possess the legal capacity to enter binding agreements.
By creating an account or using digital services, the user represents and warrants compliance with this requirement.
16. Force Majeure
Blade shall not be responsible for failure or delay in performance of digital services, connectivity, or system functionality caused by events beyond its reasonable control, including but not limited to:
• Natural disasters;
• Telecommunications disruptions;
• Governmental actions;
• Export restrictions;
• Sanctions enforcement;
• War, civil unrest, or labor disputes.
17. Military, Governmental, and Restricted Use
Blade Products and Services are not authorized for military, paramilitary, defense, or governmental security applications unless expressly approved in writing by Blade.
Users may not deploy, integrate, resell, or use Blade Products in:
• Military vessels;
• Defense-related operations;
• Law enforcement tactical operations;
• Sanctioned or restricted defense programs;
without prior written authorization from Blade.
Unauthorized deployment in such applications constitutes a material breach of this Policy and may result in immediate suspension of services.
Users are responsible for ensuring compliance with all applicable export control, sanctions, and dual-use regulations prior to deployment in any governmental or defense-related context.
18. High-Speed Racing and Performance Modification
Blade Products are not designed or certified for high-speed racing applications, competitive performance modification, or operation outside published technical specifications unless expressly approved in writing by Blade.
Users may not:
• Modify propulsion systems for racing performance;
• Override speed limitations;
• Alter control parameters for competitive use;
• Install unauthorized components intended to increase output beyond rated specifications.
Unauthorized performance modifications void warranty coverage and may result in suspension of digital services.
19. Relationship to Other Terms
This Acceptable Use Policy forms part of Blade’s broader legal framework governing its products and services, including without limitation the Website Terms of Use, Ordering Terms and Conditions, Warranty Policy, Privacy Policy, and any applicable Digital Services or Connectivity Terms.
In the event of a conflict between this Policy and other Blade terms, Blade may determine the applicable interpretation to preserve system integrity, safety, and compliance.
Nothing in this Policy limits Blade’s rights under any separate written agreement.
20. Safe Operation and Operator Responsibility
Users and operators agree that Blade Products are propulsion systems intended for use only by competent and legally qualified individuals.
Users and operators must:
• Operate all vessels in a safe, prudent, and lawful manner;
• Maintain proper lookout and navigational awareness at all times;
• Comply with all applicable maritime safety regulations;
• Ensure the vessel is equipped with legally required safety equipment;
• Operate the vessel within rated specifications and environmental limits.
Operation of a vessel powered by a Blade Product while under the influence of alcohol, narcotics, controlled substances, or any impairing substance is strictly prohibited.
Users agree not to operate, and not to permit operation of, any Blade-powered vessel by any person who is impaired, intoxicated, unlicensed where required, or otherwise legally disqualified from vessel operation.
Blade shall not be responsible for any damage, injury, death, or environmental harm arising from unsafe, reckless, negligent, or intoxicated operation.
21. Updates to this Policy
Blade may update this Policy from time to time. Continued use of Blade Products or Services after updates constitutes acceptance of the revised Policy.
22. Severability
If any provision of this Policy is found to be invalid or unenforceable under applicable law, the remaining provisions shall remain in full force and effect.
