Blade Mobile Application Terms and Conditions

1. Acceptance of Terms
By downloading, installing, accessing, or using the Blade mobile application (the “App”), you agree to be bound by these Mobile App Terms and Conditions (“App Terms”).
Your use of the App is also governed by Blade’s:
• Privacy Policy
• Acceptable Use Policy
• Website Terms and Conditions
• Consumer Ordering Terms and Conditions (if you have purchased Blade products)
These policies are incorporated into these App Terms by reference and form part of the binding agreement between you and Blade. In the event of a conflict:
• Consumer Ordering Terms govern product sales;
• These App Terms govern App functionality and software use;
• The Privacy Policy governs data processing matters.
If you do not agree to all applicable terms and policies, you must not use the App.
2. License to Use the App
Blade grants you a limited, non-exclusive, non-transferable, revocable license to use the App solely for personal, non-commercial use in connection with Blade products.
You may not:
• Reverse engineer, decompile, or modify the App;
• Circumvent security or authentication mechanisms;
• Use the App in violation of the Acceptable Use Policy;
• Use the App for unlawful, commercial, or unauthorized purposes.
All intellectual property rights remain the exclusive property of Blade.
3. App Function and Informational Nature
The App may display telemetry, diagnostics, battery data, firmware status, GPS or location data, performance metrics, and other system information derived from hardware, firmware, wireless connections, or third-party services.
You acknowledge that:
• Data may be delayed, estimated, incomplete, inaccurate, corrupted, or unavailable;
• Connectivity interruptions may occur;
• Firmware or hardware errors may affect displayed information;
• The App may not reflect real-time system conditions.
The App is provided for informational and convenience purposes only.
You agree not to rely on the App for safety-critical, navigational, emergency, or life-protecting decisions.
4. Not a Safety, Navigation, or Emergency System
The App is not:
• A certified marine navigation device;
• A vessel control system;
• A collision avoidance system;
• An emergency alert system;
• A substitute for legally required maritime safety equipment.
You remain solely responsible for safe vessel operation, compliance with maritime law, and the use of certified safety equipment.
5. Software Updates and Connectivity
The App may require updates, firmware synchronization, Bluetooth connectivity, or internet access to function properly.
Blade may release updates, patches, or modifications at its discretion.
Blade does not guarantee uninterrupted, secure, or error-free operation.
6. Warranty Disclaimer (Software)
To the fullest extent permitted by law, the App is provided “AS IS” and “AS AVAILABLE,” without warranties of any kind, whether express, implied, statutory, or otherwise.
Blade disclaims implied warranties of merchantability, fitness for a particular purpose, and non-infringement, except to the extent such disclaimers are prohibited by mandatory consumer protection law.
Nothing in these App Terms limits non-excludable statutory rights.
7. Limitation of Liability
To the fullest extent permitted by applicable law:
• Blade shall not be liable for indirect, incidental, consequential, special, punitive, or exemplary damages;
• Blade shall not be liable for loss of profits, loss of data, vessel damage, property damage, environmental damage, or business interruption arising from App use;
• Blade shall not be liable for reliance on telemetry or diagnostic data.
Blade’s total liability arising out of or relating to the App shall not exceed the greater of:
(a) The amount paid for the Blade product connected to the App; or
(b) USD $100.
This limitation does not apply where prohibited by mandatory consumer protection law.
8. Data Protection and Privacy
Use of the App is subject to Blade’s Privacy Policy, which describes how personal data is collected, processed, stored, and protected.
By using the App, you acknowledge and consent to data processing in accordance with the Privacy Policy.
The App may collect device identifiers, diagnostic information, usage data, and product performance data.
While Blade implements reasonable technical and organizational security measures, no system is completely secure. Blade does not guarantee absolute data security.
Nothing in these App Terms limits rights under applicable data protection laws.
9. Third-Party Platforms (Apple & Google)
If you download the App through Apple App Store or Google Play:
• Apple Inc. and Google LLC are not parties to these App Terms;
• They are not responsible for maintenance, support, or warranty;
• Any claims relating to the App are solely between you and Blade;
• Your use must comply with applicable platform terms.
Apple and its subsidiaries are third-party beneficiaries of these App Terms to the extent required by Apple’s App Store rules.
10. Dispute Resolution
Where permitted by law, disputes relating to the App shall be resolved by binding arbitration in Hong Kong under HKIAC rules. Class actions and jury trials are waived to the extent permitted by law.
11. Governing Law
These App Terms are governed by the laws of Hong Kong SAR, without regard to conflict-of-law principles, subject to mandatory consumer protection laws of your country of residence.
12. Indemnification
You agree to indemnify and hold harmless Blade, its officers, directors, employees, and affiliates from claims arising out of:
• Your misuse of the App;
• Your violation of these App Terms or the Acceptable Use Policy;
• Your unlawful or unsafe vessel operation;
• Your breach of applicable law.
This indemnification applies only to the extent permitted under applicable consumer protection law.
13. Modifications and Termination
Blade may modify, suspend, or discontinue the App at any time.
Updated App Terms will be published within the App or on Blade’s website. Continued use after updates constitutes acceptance.
